Sous l'effet d'une évolution économique et technique des modes de production et de consommation des oeuvres, l'exercice de la propriété littéraire et artistique s'est progressivement écarté des principes de base sur lesquels elle s'appuyait. Les évolutions actuelles remettent en cause les systèmes de protections existant dans leur essence et structure même, dans leurs modalités opératoires, dans la définition de leurs camps d'application, dans la définition des acteurs économiques. On observe, en particulier, un glissement qui fait que ces systèmes de protection ne visent plus simplement à protéger des auteurs et des créateurs, mais aussi, de plus en plus, à encourager la croissance et le développement des supports de diffusion.
ECONOMIC AND TECHNOLOGICAL DEVELOPMENTS AND NEW FORMS OF LITERARY AND ARTISTIC PROPERTY RIGHTS

Under the effect of economic and technological changes in the
modes of production and consumption of works of art, the exercise
of literary and artistic property rights has gradually digressed
from the principles on which tbey were based. Current developments
undermine the very essence and structure of existing copyright
systems, as well as their modes of operation and the definition
of their scope of application and that of the economic actors
concerned. In particular, we note a shift in focus, SO
that these systerns of protection are no longer aimed only
at protecting authors and creators but also, more and more, at
encouraging the growth and development of mediums for diffusion.

On essaie de montrer que la pluralité des droits sur la propriété intellectuelle et la diversité des biens protégés demandent des variations correspondantes dans le domaine de la traditionnelle analyse économique du droit et dans ses applications normatives. Dans la première partie, on analyse le thème du caractère non cumulatif de la connaissance culturelle artistique. Dans la seconde, on examine les effets de la non obsolescence de la connaissance non cumulative sur la protection juridique des oeuvres de la création artistique.
INTELLECTUAL PROPERTY CULTURAL GOODS AND NON-CUMULATIVE KNOWLEDGE

This paper investigates the main differences between non-cumulative
cultural knowledge and cumulative scientific and technological
knowledge. The author shows that the plurality of intellectual
property rights and the diversity of the goods to be protected
require corresponding variations in traditional economic analysis
of copyright laws and in its normative applications.
In the first section he analyses the non cumulative nature of
cultural artistic knowledge and, in the second, the effects of
the non-obsolescence of non-cumulative knowledge on the legal
protection of creative work.

If we agree that, paradoxically, copyright is an exception
to the principle of the free circulation of ideas, its maintenance
becomes truly cballenging at a time wben the appearance of new
technologies and the combination of national and transnational
legislation are turning into increasingly complex issues. Enhancing
protection and extending its duration, witbout overlooking the
growth of the cultural heritage, are the main characteristics
of this new legal challenge.
UN REGIME DE DROIT D'AUTEUR : LA PROPRIETE INTELLECTUELLE DU LOGICIEL

La question de la propriété intellectuelle du
logiciel s'est posée dès lors que celui-ci a acquis
une autonomie économique à l'égard des plates-formes
matérielles avec lesquelles il était initialement
commercialisé. Sa protection se heurte à un dilemme
entre la nécessité d'incitation à l'innovation
par un retour sur investissement pour l'innovateur et celle de
ne pas bloquer les mécanismes de diffusion de la technologie
au sein d'une activité industrielle très marquée
par le caractère cumulatif du progrès technique
et les effets d'externalités de réseaux. Le recours
à la législation du droit d'auteur, à défaut
de la construction d'un système approprié de protection,
se révèle un compromis plus viable que le système
des brevets dont les effets de cloisonnement et de verrouillage
s `avèrent tout particulièrement préoccupants.
Au reste la question centrale de la révélation des
interfaces, nécessaire àassurer l'interopérabilité
des logiciels, semble trouver dans la standardisation une solution
acceptable et compatible avec la propriété intellectuelle.
A SYSTEM OF COPYRIGHT: INTELLECTUAL PROPERTY RIGHTS ON SOFTWARE

The question of intellectual property rights on software was
raised as soon as the latter acquired a substantial degree of
autonomy in relation to the hardware with which it was initially
sold. Its protection was faced with a dilemma: on the one hand
the need to stimulate innovation through a return on investments
and, on the other, the importance of not blocking mechanisms of
technology diffusion within an industrial activity characterized
by the cumulative nature of technological progress and the effects
of network externalities. Recourse to copyright laws, for want
of an appropriate system of protection, has proved to be a more
viable compromise than the patent system of which the effects
of partitioning and lock-in have proved to be a cause for much
concern. Moreover, the key question of revealing interfaces, required
for the interoperability of programs, seems to find a solution
in standardization that is both acceptable and compatible with
intellectual property rights.

La nature des brevets accordés dans le domaine des biotechnologies a beaucoup évolué au cours des vingt dernières années avec la multiplication des protections légales concernant des organismes génétiquement modifiés ou la structure de gènes. L'article propose une analyse de ces changements basée sur l'idée selon laquelle les brevets ne constituent qu'une des nombreuses possibilités d'appropriation des connaissances et savoirs-faire scientifiques. Une première partie rappelle la diversité historique des modes d'appropriation qui ont caractérisé le secteur des biotechnologies en analysant trois configurations : le don/contre-don, le monopole instrumental et l'appropriation incorporée dans les matériaux. La seconde partie présente le développement récent de la génétique du cancer du sein pour introduire et discuter trois aspects des nouvelles pratiques : la redéfinition des frontières entre public et privé, la montée des dispositifs formels destinés à gérer les échanges au sein des consortia de recherche et le débat public sur les modalités (et les limites) juridiques de l'appropriation.
RIGHTS AND APPROPRIATION IN THE FIELD OF BIOTECHNOLOGY
Remarks on recent changes in practice

The nature of patents granted in the biotechnology field has
changed a great deal over the past two decades with the proliferation
of patents on genetically modified organisms or the structure
of genes. This article proposes an analysis of these changes,
based on the idea that patents are only one of the many possible
forms of appropriation of scientific knowledge and know-how. The
first part recalîs the historical diversity of the modes
of appropriation which have characterized biotechnology, by analysing
three configurations: the gift/counter-gift, the instrumental
monopoly, and appropriation incorporated in materials. The second
part presents recent developments in breast cancer genetics, as
a way of intro ducing and discussing three aspects of new practices:
the redefinition of the boundaries between public and private,
the increase in formal apparatus for regulating exchange within
research consortia, and the public debate on the legal modalities
(and limits) of appropriation.

L'une des questions fondamentales auxquelles est confronté le droit d'auteur aujourd'hui est celle de sa mise en oeuvre. Depuis sa reconnaissance législative il y a deux siècles, il s'appuie sur le système de la gestion collective, un ensemble de sociétés qui contrôlent les exploitations des oeuvres, perçoivent les droits et les répartissent à leurs ayants droit. Mais s'il a été créé comme agent de rationalisation, le système évolue maintenant selon une logique propre de segmentation et de spécialisation, parfois opposée à la logique de rationalisation.

One of the fundamental questions facing copyright today is
that of its application. Since its legal recognition two centuries
ago it has been based on the system of collective management by
a group of companies which control the exploitation of the works,
collect the royalties and distribute them to the beneficiaries.
Yet, while it was created as an agent of rationalization, the
system is now developing according to a logic of segmentation
and specialization, sometimes opposed to that of rationalization.

L'industrie du Luxe a été, de tous temps, imitée
ou copiée à l'instar des autres secteurs de l'industrie,
mais cette contrefaçon s'est intensifiée et diversifiée
davantage et plus vite.
Le déploiement de cette industrie française sur
les marchés internationaux durant la deuxième moitié
du xxe siècle, assorti de déclinaisons et diversifications
multiples et servi par l'amplification du réseau de distribution
et par la progression des moyens de communication, a suscité
un développement exponentiel de la contrefaçon des
marques et des produits dans toutes les zones.
Pâtissant de cette perversion sur le plan économique
et au niveau de la notoriété des marques, la France
a mis en place, simultanément, le dispositif le plus puissant
au monde de protection des créations et des marques et
de lutte contre la contrefaçon.
FAKES IN THE WORLD OF LUXURY

Like other sectors, the luxury goods industry bas always been
imitated or copied. However, counterfeiting in this domain has
intensified and diversified faster and to a greater extent than
elsewhere.
The international market penetration of this French industry during
the latter haîf of the twentieth century, accompanied by
multiple variations and diversification, and served by the growth
of the distribution network and new means of communication, led
to the exponential and widespread development of the counterfeiting
of brands and products.
As a victim of this corruption, both economically and regarding
the prestige of its brands, France established the world's most
powerful system for protecting creations and brands and fighting
against counterfeiting.

des journalistes à travers la fabrication du sujet Algérie
sur les écrans de la chaîne nationale (ENTV), des
chaînes françaises France 2, TF1 et saoudienne MBC.
Elle repose également sur l'analyse d'audience qualitative
dans une nouvelle métropole algérienne, Tizi Ouzou.
Dans ce champ de recherche encore en friche, elle trace les premières
perspectives de construction des journaux télévisés
comme objets d'étude et éléments constitutifs
déterminants.
ALGERIA : AN ARENA FOR DEMOCRATIC DEBATE
Condilions for the practice of journalism and reception of national
and foreign TV programmes

This paper draws on a case study of the outcome of journalists'
work though the creation of the subject Algeria on the national
TV channel (ENTV) and the French and Saudi Arabian channels (France
2, TF1 and MBC respectively). It is also based on qualitative
audience studies in the new Algerian city, Tizi-Ouzou.
In this as yet undeveloped research field, the author identifies
the initial prospects in the construction of TV news as research
subjects and determining constituent elements.
